Our Applicant Privacy Notice

 

What does this notice cover?

This Privacy Notice applies to the processing of personal data, which means information about an identifiable individual ("you") that the Getlink company concerned (“the Company” or “we” or “us” or “our”) processes when you apply for a position with it.

It also describes your data protection rights, including a right to object to some of the processing which we carry out. More information about your rights, and how to exercise them, is set out in the "What are your choices and rights?" section below.

We may also provide you with additional information when we collect personal data, where we feel it would be helpful to provide relevant and timely information.

 

What personal data do we collect?

We obtain your personal data because you have created an applicant profile on our recruitment platform and you have submitted an application for a position with us (either directly or through a recruiter). This personal data includes:

  • Data that you provide to us when you create your applicant profile, includes :
    • Your name ;
    • Your surname ;
    • Your phone number ;
    • Your personal email address (Please only provide a personal email address. We will only send emails to  your personal address) ;
    • Your postal address.

 

  • Data that you provide to us when you apply to a job, may include : 
    • Curriculum Vitae ;
    • Cover letter ;
    • Recommendation letter (for position based in France);
    • Previous professional experiences ;
    • Detail of previous employer/s ;
    • Graduation, level of training, certifications ;
    • Linguistic skills ;
    • Extra-professional activities ;
    • Driving licence (depending on the role applied for) ;
    • National Insurance Number (for positions based in UK) ;
    • Detail of any period of absence from the UK during 6 consecutive months in the past 5 years (only applicable if the applicant is English and is applying for a job based in the UK) ;
    • Date and place of birth ; 
    • Nationality ;
    • Type of job requested.

 

  • The information that we exchange during the process of recruitment:
    • The organisation of interviews ;
    • The report of interviews ;
    • The salary requested ;
    • The emails exchanged ;
    • The results of your tests ;
    • Your identification documents (passport).

 

  • Data from other sources: We obtain data about you from other sources, including recruiters, employment research firms, identity verification services, the references you provide to us, websites and other publicly accessible data on the Internet. We will also receive data you submit to us through third-party websites. Where permitted – for positions based in UK - we collect details of professional registrations, and sanctions with professional bodies, financial checks or criminal convictions where you have consented to background checks.

 

  • Information we collect automatically: When you make an application through our application, we will collect information sent to us by your computer, mobile phone or other access device. For example, this includes the pages you access, your computer IP address, device identifiers, the type of operating system you are using, mobile network information, standard web log data and other information, your browser type and traffic to and from our site.

 

Verification and staff checks

For some positions, it will be necessary for us to verify the details you have supplied (for example, in relation to your identity, academic credentials or your employment history) and/or carry out pre-employment checks (for example, in relation to previous criminal convictions or financial standing – for positions based in UK).

The level of required checks will vary by position and will usually be conducted at as late a stage as is practicable in the recruitment process and often only after you have been selected for the position. If your application is successful, we will provide further information about the checks involved and will obtain any necessary consent prior to completing such checks. 

Please ensure you have the consent of the referee(s) whose details you provide alongside your application for us to use their personal data as outlined in this Notice.

 

How do we use this personal information and what is the legal basis for its use?

We collect, use and store your personal data for the following purposes:

  • Where this is necessary for us to review and assess your application for employment:​
    • This includes assessing your skills and interest in career opportunities with us, processing your application, analysing your qualifications, verifying your identity and eligibility for employment including, where appropriate – for positions based in UK - criminal record and financial credit checks, and communicating with you about your application to respond to your enquiries and schedule interviews.

 

  • Where necessary for our legitimate interests, as listed below, and where these interests are not overridden by your data protection rights:​
    • ​Protecting our legal rights. This includes, but is not limited to, use in connection with legal claims, compliance, regulatory, auditing, investigative and disciplinary purposes (including disclosure of such information in connection with legal process or litigation) and other ethics and compliance reporting requirements.
    • Maintaining the security and integrity of our facilities, equipment and electronic platforms. This includes administering access rights, monitoring compliance with company protocols, and where permitted by local law (UK law) and in accordance with relevant policies, for investigations and disciplinary actions.

  • Where necessary to comply with a legal obligation:​
    • Disclosures to law enforcement agencies or in connection with legal claims, or regulatory purposes (including disclosure of such information in connection with legal process or litigation).

 

  • Where necessary for the purposes of carrying out obligations in the field of employment and social security and social protection law under local law (under Article 9(2)(b) GDPR):​
    • Where permitted by local law (UK law), information revealing race, ethnic origin, sexual orientation and any disability may be processed in order to facilitate effective equal opportunities monitoring and/or to comply with legal obligations to make reasonable adjustments.

 

  • Where you have given consent:​
    • We may ask for your consent to carry out certain verification and staff background checks where this is required in connection with your role. Where we do process data based on consent, your consent can be withdrawn at any time.

 

How do we justify our legitimate interests?

We have carried out balancing tests for all the data processing we carry out on the basis of its legitimate interests, which we have described above. You can obtain information on our balancing tests by contacting us on the details below. 

If it is mandatory for you to provide data for these purposes, we will make this clear at the time the data is collected and will also explain what will happen if you do not provide the data. 

 

How long will we retain your personal data for?

We will retain your personal data only for as long as we need it for our legitimate interest in accordance with applicable law, in relation to the purpose for which the data was collected.

Concerning the data required for a creation of your applicant profile, we keep the data as long as your profile is active and regularly accessed by you. If, at the end of 6 months, you have not accessed your applicant profile, we shall send you an email asking you to confirm whether the data we hold is accurate. In case of inaction from you, the profile and your data will be deleted. Maintaining an active profile enables you to remain registered as an applicant, update documents such as your CV within the profile and apply for positions more easily.

Regarding the data submitted as part of an application and the information exchange during a recruitment process for a specific role, we keep the data for a period of 6 months in case of no selection or no continuation of the recruitment process.

However, if you accept employment with us, we will retain your personal data throughout your employment in accordance with a separate notice we provide to you upon your acceptance of employment with the Getlink group company. 

 

How will we share your personal data?

We will share your personal data with other members of the Getlink Group to administer and manage group functions, including to make systems available to our employees or to refer you for other open positions.

Your personal data will also be shared with companies providing services under contract to us, such as training providers, recruitment platforms, help desk providers and IT hosting and/or IT maintenance providers.

Personal data will also be shared with government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the protection of our legitimate interests in compliance with applicable laws.

In the event that we or Getlink are sold or integrated with another business (in part or whole), your details may be disclosed to our advisers and any prospective purchaser's adviser.

 

What are my choices and rights?

The accuracy of the information that we hold about you is important to us.  If any of the information that we hold is inaccurate or out of date, please let us know using the contact details set out at the end of this Privacy Notice. You also have the right: 

  • To ask us for a copy of your personal data ;
  • To have your personal data corrected if it is inaccurate or incomplete ;
  • To restrict the processing of your personal data ;
  • To obtain the personal data you provide in a structured, machine readable format and ask us to share (port) this personal data to other organisations ;
  • To object to processing in some circumstances.

Where we have asked for your consent, you may withdraw consent at any time. If you ask to withdraw your consent to our processing your personal data, this will not affect any processing which has already taken place at that time. You can also ask us not to send or to carry out profiling for direct marketing, at any time.

These rights may be limited in some situations – for example, where we can demonstrate that we have a legal requirement to process your data, where they would infringe the rights of a third party (including our rights) or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep. Relevant exemptions are included in both the GDPR in the French law (Informatique et Liberté 1978) and in the UK law (Data Protection Act 2018). We will inform you of any relevant exemptions it relies upon when responding to any request you make.

Updates to this Privacy Notice

This Privacy Notice may be updated periodically and any changes we make will be published on the application. Please check back frequently to see any updates or changes to the policy. If we change the Privacy Notice in a material way, we will notify you of this and, if required, we will obtain your new consent.
